Id say actor.

They have to get permission for likeness, they gets scans of the actors heads, the figures need to be approved by the actors.

The only cases where its character and not actor is heavy make up and masked characters like Judoon, Cybermen, Daleks.

Surely, they have to be based on the character. Take Brannigan. Looks nothing like Ardal O'Hanlon!
That character looks like the actor who played them so for Romana to look like Mary Tamm or Lalla Ward is a must. The toy must reflect the known image in some form.
Saying that the 1995 Star Wars range looked nothing like their actor counterparts but the aspect in terms of clothes was there it was easy to accept.

I'm pretty sure this sort of thing is actually defined under the law.

For example, I know Lucasfilm owns the rights to Chewbacca's likeness and can use it on any products without Peter Mayhew's permission.

A character where the actor's face isn't visible is handled differently than one where it is.

Continuing the theme of a subscription the next challenge is to populate the subsctiption.

The challenge is to choose 3 characters
One can be a completely new sculpt, The next two have to use those parts again with a new head or repaint.

An example is
1) Ian Chesterton in a Toga (The Romans)
2) Caecilius using Peter Capaldi head(Fires of Pompeii)
3) 11th Doctor in toga with beard (The Wedding of River Song)

The main body, arms and legs would be reused but repainted for each figure.
